1 Shot in Weekend Five Points Robbery, 2 Under Arrest

Two young Bristol Township men were arrested after a foot pursuit following a robbery that left a man shot early Saturday morning.

Aaron Day, 20, of Fleetwing Drive, and Jacob Pemberton, 18, of Pacific Avenue, were taken into custody and charged with attempted murder, conspiracy to commit murder, robbery, aggravated assault, theft, fleeing and eluding police other related offenses.

According to an affidavit of probable cause, the robbery incident started in front of the J and R Check Cashing and Pawn Shop at Five Points and ended with a large amount of blood and “human tissue” behind the New Falls Road Acme store in the Levittown section of Bristol Township.

Pemberton told police he and Day talked about “getting some money” leading up the robbery and shooting. He specified to police that the term referred to robbing someone or stealing. The duo took Pemberton’s mother’s PT Cruiser and drove around for a half hour before spotting the victim near the Getty Gas station at Five Points, according to court documents.

Pemberton and Day, with a shotgun concealed down his right pant leg, reversed the PT Cruiser into a parking spot behind the Acme and approached the victim, the men said to police.

The two young men told police they approached the victim and demanded money just after 4:20 a.m. The victim said the suspects asked him “where is the weed?” and then Day requested his money. The man put up a fight and Pemberton and Day wrestled and fought with the man before Pemberton shot the victim, according to a affidavit of probable cause.

Realizing he was hit by two shotgun blasts, the victim began screaming and running toward the parking lot of the Acme. He told police he heard the suspect yelling they had to flee. Shortly after, he saw the silver PT Cruiser drive out of the supermarket parking lot with no headlights on, court records show.

Pemberton told police the spent shotgun shells were thrown out the passenger side window of the getaway vehicle and a black bag taken from the victim was also tossed, court records show.

Police spotted the suspect vehicle on Emilie Road. They stated the car then used Woerner Avenue to access New Falls Road and the Indian Creek section. Pursuing police Officer John Terman reported the PT Cruiser sped up and attempted to flee on Indigo Road.

In their attempt to flee, Day and Pemberton pulled onto a trail at the PECO power line property, where the PT Cruiser became stuck in the mud. The two ditched the vehicle and fled on foot, according to the affidavit. Police said Pemberton was taken into custody on Ice Pond Road and Day got away until police caught up with him later in the day.

Responding officers reported finding a sawed off double barrel shotgun loaded with two rounds in the vehicle.

The victim was taken to St. Mary Medical Center in Middletown and underwent surgery to his left bicep and upper arm. Many shotgun pellets and wadding was removed from his arm, police said. The victim told authorities from his bed in the intensive care unit the gun was fired from about 8 feet away.

The two suspects were arraigned and are being held in county jail on $500,000 bail, according to court dockets.
